These Terms of Service (“Terms”) govern your access to and use of velvethour.net (the “Site”) and any purchase you make from VelvetHour.net, LLC, doing business as Velvet Hour (“Velvet Hour,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
1. Age Restriction
The Site sells products intended for adults. You must be at least 18 years of age, or the age of majority in your jurisdiction if it is higher, to use the Site or place an order. By using the Site you represent and warrant that you meet this requirement. We reserve the right to cancel any order and to refuse service where we have reason to believe this requirement is not met.
2. Eligibility and Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at care@velvethour.net if you suspect unauthorized use. You agree to provide accurate, current, and complete information when you register or check out.
3. Products, Descriptions, and Availability
We work to describe products accurately, but we do not warrant that product descriptions, images, dimensions, colors, or other content are complete or error-free. Product images are illustrative and actual items may vary. All products are subject to availability, and we may limit quantities or discontinue any product at any time.
Products sold on the Site are novelty and personal-care items. Nothing on the Site is medical advice, and no product is offered as a treatment, cure, or diagnostic for any condition. Read and follow all manufacturer instructions and warnings before use.
4. Pricing and Payment
All prices are shown in US dollars and exclude applicable sales tax, which is calculated and displayed at checkout. We accept Visa, Mastercard, American Express, and Discover.
Prices are subject to change without notice, but the price shown at the time you place your order is the price you pay. If a product is listed at an incorrect price due to a typographical or system error, we may cancel the order and refund you in full, whether or not the order has been confirmed.
By submitting an order you authorize us and our payment processor to charge your payment method for the total shown. Your statement descriptor will read VH Retail. Card data is handled by a PCI DSS compliant processor; Velvet Hour does not store full card numbers.
5. Order Acceptance
Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not constitute acceptance. A contract is formed only when we ship the item. We may refuse or cancel any order, including for suspected fraud, pricing error, product unavailability, an unverifiable address, or a violation of these Terms. If we cancel a paid order, we refund it in full.
6. Shipping and Delivery
Processing times, transit estimates, packaging, and carrier claims are governed by our Shipping & Delivery Policy, which is incorporated into these Terms. Title and risk of loss pass to you upon delivery to the carrier.
7. Returns, Cancellations, and Refunds
Cancellations, returns, exchanges, and refunds are governed by our Refunds, Returns & Cancellations Policy, which is incorporated into these Terms. In summary: orders may be cancelled before release to fulfillment; unopened, factory-sealed items may be returned within 30 days of delivery; opened intimate items are final sale for health and hygiene reasons; and damaged, defective, or incorrect items are replaced or refunded in full within 30 days of delivery.
8. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.
9. Acceptable Use
You agree not to use the Site to violate any law; to resell our products without written authorization; to interfere with or disrupt the Site or its security; to use bots, scrapers, or automated means to access the Site; to submit false or fraudulent orders; or to post unlawful, abusive, defamatory, or infringing content in any review or submission.
10. Intellectual Property
The Site and its content — including text, graphics, logos, images, and the Velvet Hour name and marks — are owned by or licensed to VelvetHour.net, LLC and are protected by intellectual property law. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission. Third-party brand names and product images remain the property of their respective owners.
11. User Submissions
If you submit a review, comment, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it in connection with the Site. You represent that you own or have the rights to the content you submit. We may remove any submission at our discretion.
12. Disclaimer of Warranties
Except as expressly stated in these Terms or as required by law, the Site and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Manufacturer warranties, where offered, are provided by the manufacturer and not by Velvet Hour.
13. Limitation of Liability
To the maximum extent permitted by law, VelvetHour.net, LLC and its officers, members, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, arising out of or relating to your use of the Site or any product purchased from it. Our total aggregate liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless VelvetHour.net, LLC from any claim, demand, loss, or expense, including reasonable attorneys’ fees, arising from your breach of these Terms, your misuse of any product, or your violation of any law or third-party right.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction. Before filing any claim, you agree to contact us at care@velvethour.net and attempt to resolve the matter informally for at least 30 days.
16. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, Shipping & Delivery Policy, and Refunds, Returns & Cancellations Policy, constitute the entire agreement between you and Velvet Hour regarding the Site.
17. Changes to These Terms
We may update these Terms at any time by posting a revised version with a new “Last updated” date. Changes apply to orders placed after the revision date. Your continued use of the Site constitutes acceptance.
